A group of WISLaw members in front of the Court of Arbitration for Sport (CAS) in Lausanne
We met with a small group of WISLaw members at the Court of Arbitration for Sport (CAS) in Lausanne. We had a fascinating discussion on the different investigatory procedures being currently conducted in the framework of the sexual abuse scandal in the U.K.
Kendrah Potts (Legal Director at Mishcon de Reya) highlighted the legal issues arising out of the different investigatory procedures in abuse & corruption cases in football. Kendrah has extensive experience in investigating doping, corruption and mismanagement allegations in International Federations. Liz Ellen (WiF director & partner at Mishcon de Reya), Despina Mavromati (Managing Counsel at CAS), Melanie Schärer (MS Entertainment Law) & other WISLaw members discussed the implications of concurrent (i.e. private and criminal) investigations in terms of burden and standard of proof, access to information, dealing with conflicting outcomes and more.
